- The signed and notarized documents are automatically sent to you and spouse and to the attorney.

Requirements for a 5 week Divorce
1- At least one spouse has been a resident of Virginia for the last six months. (Or at least one spouse has been on active duty and stationed in Virginia for the last six months.)
2- You and your spouse have been separated at least six months (no minor children) or one year (if you and your spouse have minor children).
3- To complete divorce in 5 weeks, documents must be signed and received by our office within 5 days.
Documents can be signed:
- with an online notary; or
- emailed to you to sign with a notary near you; or
- signed with a notary at our office.
If a case takes more than five weeks to complete, the Law Office will refund $25.00 per day for each day past the 5 week timeframe, provided that the following terms and conditions have been met:
- Client and spouse live in separate homes with different addresses. We can assist you with a divorce if you and your spouse are fully separated in the same home, but the guarantee does not apply in that situation.
- Client and spouse sign and return all documents within 3 days. If more than 3 days are needed by client or spouse, the 5 week guarantee does not apply to the case, but we will finalize your case as soon as possible.
- The case meets Virginia residency and separation time requirements.
- All case information provided is true and correct.
- All documents are correctly signed/notarized and returned to the office within timeframe required. Documents can be sent to the office by email, returned in person to our main office, or signed with our recommended online notary. Documents must be legible and unaltered, other than the signatures and notarization.
- All required documents are signed by client and spouse in all required spaces on documents.
- Both parties’ signatures are notarized as required by a duly authorized notary with an active notary commission.
- Notary signs in the spaces provided and affixes valid and legible notary stamp to all required documents as required by Virginia law.
- All information provided by Client for case documents is correct at start of case. No changes/corrections to information provided is needed. Any change to the case information originally provided by client or spouse restarts the 5 week clock. (example: date of marriage, date of separation, date of birth, spelling of a name, change division of assets or debts, etc.)
- Spouse does not contest the divorce, either through a court filing or any other means.
- The divorce shall be considered finalized by the date of the judge’s signature on the divorce decree.
- Client is solely responsible for forwarding or giving documents to spouse, and returning all documents to the Law Office. The Law Office shall not be responsible for sending documents to spouse or retrieving documents from spouse.
- If the court is closed due to holidays during the timeframe, the number of days that the court is closed shall be added to the timeframe.
- In the event of unscheduled court closures due to unforeseen circumstances such as extreme weather, flooding, public epidemic, etc., the number of days that the court is closed shall be added to the timeframe.
If a case takes more than 2 weeks to complete, the Law Office will refund $50.00 per day for each day past the 2 week timeframe, provided that the following terms and conditions have been met:
- Client and spouse sign and return all documents within 2 days. If more than 2 days are needed by client or spouse, the 2 week guarantee does not apply to the case, but we will finalize your case as soon as possible.
- The case meets Virginia residency and separation time requirements.
- All case information provided is true and correct.
- All documents are correctly signed/notarized and returned to the office within timeframe required.
- Documents can be sent to the office by email, returned in person to our main office, or signed with our recommended online notary. Documents must be legible and unaltered, other than the signatures and notarization.
- All required documents are signed by client and spouse in all required spaces on documents.
